Photo Day Terms & Conditions

These terms apply when you register your child for photos with Red Cherry Kindy & Childcare Photography, (Red Cherry Images). By completing the registration form and paying the $35 deposit, you agree to these terms, so please read them before you pay.

In short: photos are optional. The $35 deposit is a credit towards a photo package that you choose after viewing your gallery. It is refunded only if your child is not photographed. If you decide not to order, the credit is not refunded.

1. Registration and consent

• Photography is optional only. 
• By registering and paying the deposit, you give permission for us to photograph your child during the centre's scheduled photo session.
• Children must be registered before photo day to have individual photos taken or to be included in a composite class photo. Permission only must be given if we are doing traditional style class photos at your centre. All children are included registered or not - but we do need to obtain permission. Please ask your teacher/director where to sign for permission only. (NB: registration automatically gives permission).
• Late registrations may be missed. During sessions we are busy photographing children, and centre policy limits our use of mobile phones to check for new registrations.
• A deposit of $35 is paid for each child registered.

2. Your $35 deposit and photo credit

The $35 deposit covers our time to photograph multiple images of your child. It is given as credit to use at checkout. 

• The deposit covers a session of at least 5 individual photos of your child, edited and shown in a private online gallery.
• When your gallery is ready, you receive a credit redeem code for $35 by email.
• The credit can only be used towards a photo package. Packages start from $42. The full price list is shown during registration. 
• The credit must be used in one order and cannot be split across orders
• The credit is only given to the parent or guardian who registered the child.
• If you choose not to order, or do not use all of your credit, the unused amount is not refunded. The deposit has paid for the session, editing and gallery, which have been provided.

3. Refunds

The deposit is refunded in full only if your child is not photographed because they are:

• Absent on photo day and we cannot photograph them on another day we are at the centre. (we cannot offer makeup days as our schedule is very full). 
• Visibly distressed or not unwilling to be photographed (we will not continue photographing a child in this situation)

Refunds are processed in the week after the centre's photo days. The deposit is not refunded for any other reason, including a change of mind after viewing the gallery. We do our absolute best to capture beautiful photos of your child. 

4. Your private gallery

• About 5 to 7 days after photo day, you receive an email and SMS with your gallery passcode and your $35 credit redeem code. Please check your junk or spam folder.
• Your gallery is private. Access is by a unique passcode sent only to the parent or guardian who registered the child.
• You may share gallery access with others as you see fit. We do not give access details to anyone else without written, verified permission from the registered parent or guardian.
• Gallery images are watermarked and partly blurred of which you can click the button under the photo to reveal the image in 2 halves. This protects children's photos from being copied or downloaded, because standard watermarks can now be removed easily with AI tools. Your purchased photos have no watermark or blurring.
• Your gallery is open for ordering for 2 months only.

5. Choosing and ordering your package

1. View your gallery after details are emailed to you (5 -7 days after the last day at your centre). 
2. Choose a photo package. You do not need to decide on a package until you have seen your photos.
3. Enter your credit redeem code at checkout. The $35 is taken off your package price.
4. Choose whether your images are archived or deleted after your order is complete (see section 9).

A class photo can be added to a package at a reduced price. Prints are delivered to the centre if you order by the due date for print orders. If ordering after the due date an $18 postage fee is applicable and you can opt to send to the centre or home address.

6. Siblings

• We take sibling photos only of children who are both enrolled at the centre and both registered for photos.
• Please select the same photo day for all your children at the centre.
• Sibling photos are shown in the youngest child's gallery ONLY. This is instead of creating a 3rd gallery to choose photos from- so this benefits you as you can add sibling photos into that child's photo package you select instead of ordering a separate photo package from another gallery.
• In the case of twins - sibling photos taken together are placed into 1 child's gallery. 
• Each child's registration includes its own $35 deposit and credit. 
• A separate package purchase is required for each child and you will not be able to mix photos from each child's gallery into 1 photo package. 
• Please do not email us asking to combine photos into 1 package for both children as we spend time capturing photos for each child and then additional time, effort and energy to capture sibling photos. For fairness for all families - photo packages are priced PER child.  

7. Class photos

Your centre will have either a composite or a traditional class photo as per centre preference when booking our photography service. In most instances - childcare centres now are either opting for a composite style class photo OR no class photos.
This information is shown on your registration page as to which type of class photo is offered if any. 

Composite class photos

• A composite is an 8x10" print made up of the individual photos of each registered child.
• Only children registered for individual photos are included on the composite class photo.
• Children are shown by first name only.

Traditional class photos

• All children in the class who are present on class photo day are included that have permission to be in the class photo, unless a parent, guardian, educator or director has told us otherwise.
• If your child is not registered for individual photos but you would like them in the class photo, please complete our consent form at the centre before photo day, otherwise teachers/staff need to call you to confirm and if they cannot reach you - unfortunately your child has to be excluded from the class photo. 
• NB: if you have registered - that is permission to be in the class photo unless we have been told otherwise. 

For both types

• Class photos are $35 each on their own, or can be added to a package at a reduced price. They are available as a print only.
• To protect the privacy of every child in the class, there is no preview of the class photo before purchase.
• If you do not want your child included in the class photo, email trina@redcherryimages.com.au before photo day so we can let the educator or director know.

8. Child safety and privacy

• Photo sessions follow child-safe practices at all times, in line with centre policies and our Keeping Children Safe policy.
• Photos are not shared publicly unless you gave us social media/promotional permission on the registration form.
• Identifying details are never attached to any photo we display publicly.

9. Image storage and deletion

When you place your order, you choose whether your child's images are archived or deleted once your order has been delivered.

• Archive: images are stored securely for up to 3 years, so we can help if your files are lost. (Fee involved to retrieve after the current calendar year).
• Delete: all image files are permanently deleted and cannot be recovered later in digital or print form. Please consider this before selecting this option and make sure to back up your images to 2-3 places to avoid loss of photo files and subsequent disappointment when you email us to see if we have the images and we have inform you they have been deleted. 

If you do not order, your images are archived for up to 3 years. To have them deleted instead, email trina@redcherryimages.com.au.

10. Terms of purchase

These terms apply when you place an order from your gallery. A summary is also shown at checkout.

Before you pay

• Check your cart before payment to make sure it holds the images you want.
• The due date for print orders is shown in your gallery email / at the top of your gallery.

Changes and refunds

• Digital downloads are not refundable on a change of mind, because they are available to download straight away.
• You can change the images chosen for prints within 24 hours of ordering, as long as the print order due date has not passed.
• After the print order due date, printed images cannot be changed.
• If your package includes a digital file of a printed image, that image choice cannot be changed.

Digital files

• Digital images are high-resolution JPG files, 18 inches on the longest side, suitable for prints up to 16 x 24 inches.
• RAW files are never supplied.
• Please download your files to a desktop or laptop computer straight after purchase. They can be downloaded until 31 December of the year of purchase. After that they are archived, and a fee of $25 applies to retrieve them.

Using your photos

• Purchased images are for personal use only. Any other use needs our written permission, and a fee may apply.
• You may share purchased photos on your own social media. Please do not add filters or edit them. We would appreciate a tag: @redcherryimages

Printing your digital files

• We recommend a professional print lab for correct colour and quality. See our tips on printing your digital files.
• Avoid large crops, as print quality drops noticeably.
• We are not responsible for print results from non-professional print outlets, or from files that were not downloaded at full resolution.

Class photos

• Class photos are supplied as an 8 x 10 inch print only, never as a digital file.
• Please do not share class photos publicly on any platform. They show the names and images of other children, which you do not have permission to share.

Unpurchased images

• Screenshots, prints, copies or shares of gallery images you have not purchased are not permitted. All images are protected by copyright.
